Yes. Mediation is confidential, allowing parties to communicate openly for settlement purposes. Except in limited circumstances required by law, the mediator cannot disclose what was discussed during mediation.
Mediations are typically scheduled for four hours (half day) or eight hours (full day). However, the session may continue if the parties are making progress toward a settlement. Most cases are resolved or reach an impasse within the scheduled time.
If a party fails to appear for mediation, the mediator will notify the Court that the mediation could not proceed and no settlement was reached.
Unless otherwise ordered by the Court or agreed upon by the parties, each party is responsible for their own mediation fee for the scheduled mediation time.
If mediation is canceled within 24 hours and not rescheduled, the mediator may charge a discretionary $200 cancellation fee.
If the parties do not reach an agreement in mediation, the mediator will notify the Court that no settlement was reached. The parties may then proceed before the Judge to resolve the remaining issues.
